Poll shows public support for Japan PM falls again (AP)

TOKYO ? Public support for Japan's prime minister and his Cabinet has fallen 2.5 percentage points over the last month, as the administration's numbers continue to decline, a poll released Sunday shows.

Public approval for Prime Minister Yoshihiko Noda and his Cabinet stood at 44.6 percent in the Kyodo News agency poll. The administration's disapproval rating rose 6 points, to 40.3 percent.

Support for Noda has steadily declined since he took office in early September.

New prime ministers in Japan typically begin with relatively robust approval ratings, only to see them drop steadily after a brief honeymoon period. Noda is Japan's sixth prime minister in five years and faces a public frustrated with disaster reconstruction efforts and a lackluster economy.

Verbal gaffes have also hurt the Cabinet's image.

Noda's first trade minister resigned just eight days into the job after making comments seen as insensitive to nuclear crisis evacuees. Now Defense Minister Yasuo Ichikawa's days could be numbered as well.

Ichikawa is under fire for remarks made by his ministry's top official in Okinawa, where plans to relocate a U.S. Marine air base face strong opposition. The official, who has been dismissed, reportedly likened the move to rape, implying that the government would force its way onto the island.

The resulting outcry further intensified after Ichikawa told parliament that he was unfamiliar with details about the 1995 rape of an Okinawan schoolgirl by three U.S. servicemen. The incident fueled anti-American sentiment and concerns over U.S. military presence.

The opposition Liberal Democratic Party plans to submit a censure motion again Ichikawa on Friday.

Among other topics, respondents in the poll expressed wariness over the government's plans to raise the 5 percent consumption tax. More than half of those surveyed said they wanted a general election before a hike is enacted.

More than 71 percent said they wanted a realignment of political parties. The high figure suggests voters are unhappy with the status quo of two big political parties and several minor parties.

Kyodo randomly surveyed 1,021 eligible voters by telephone over the weekend. A poll of that size would typically have a margin of error of 5 percentage points.

The sample did not include areas in northeastern Fukushima prefecture that were evacuated because of the nuclear crisis spawned by the massive earthquake and tsunami last March.

Michael Jackson doctor files appeals notice in LA (AP)

LOS ANGELES ? The doctor sentenced to four years behind bars for causing Michael Jackson's death has filed a notice that he intends to appeal the conviction.

Conrad Murray signed a one-page document that was filed in Los Angeles on Friday seeking all records and transcripts from the case. The filing does not indicate the basis on which Murray will argue to overturn his conviction or sentence.

The 58-year-old was sentenced Tuesday to four years in jail for his involuntary manslaughter conviction, but the term will be automatically cut in half.

Murray's challenge will be heard by a state appeals court in Los Angeles, assuming he files an opening brief at a later date.

Superior Court Judge Michael Pastor blasted Murray's conduct on Tuesday, calling him a disgrace to the medical profession.

Afghan president pardons imprisoned rape victim (AP)

KABUL, Afghanistan ? Afghan President Hamid Karzai is pardoning an Afghan woman serving a 12-year prison sentence for having sex out of wedlock after she was raped by a relative.

Karzai's office also said the woman and her attacker agreed to marry. That would reverse an earlier decision by the woman, who had previously refused a judge's offer of freedom if she agreed to wed the rapist.

Thursday's statement says Karzai decided to forgive the rest of the woman's sentence after hearing from judicial officials. It's not clear how much time the woman has served.

Her plight was highlighted in a documentary blocked by the European Union because it feared the women profiled would be endangered by its release.

More than 5,000 people signed a petition urging Karzai to release her.

Apple?s Siri on iPhone 4s and Legal Privilege

I thought that Slaw readers might be interested in this observation by BLG partner, Norman Letalik, as a result of his recent exchange with Apple Canada?s regional counsel. (The following quotation is from an email thread in a group to which I belong and is reproduced with Norm Letalik?s permission.)

Note that I have now had a telephone conversation with Ms. Famulak, who is regional counsel for Apple Canada. She confirms that the information that is dictated on the Apple iPhone 4s using the Siri dictation feature is sent to servers that reside in the US and that Apple, its related companies and agents have access to the contents of what is dictated. She did not wish to opine on whether Apple?s ability to access dictated client communications would breach legal privilege in Ontario or elsewhere. So, the best practice would be not to use the dictation feature on an iPhone 4s for any dictated information to which you intend legal privilege to attach. Note as well that Apple?s dictation servers are located in the US, so the dictated information may also be scanned for national security purposes by the US Government pursuant to powers given to it under the Patriot Act.

In his request to Ms Famulak, Mr. Letalik noted that lawyers ?likely did not read your 364 pp user agreement document carefully enough to understand the implications of the above terms and conditions.?

The problem with privilege in this context is explained by Professor Adam Dodek, a new contributor on Slaw, in his February 2011 discussion paper for the Canadian Bar Association, ?Solicitor-Client Privilege in Canada: Challenges for the 21st Century?:

As the House of Lords has stated, the sine qua non of privilege is confidentiality: ?Unless the communication or document for which privilege is sought is a confidential one, there can be no question of legal advice privilege arising. The confidential character of the communication or document is not by itself enough to enable privilege to be claimed but is an essential requirement.? The CBA has issued ?Guidelines for Practicing Ethically with New Information Technologies,? which declares that ?Lawyers should exercise the same care to protect the confidentiality and privilege of electronic communications as is normally expected of them using any traditional form of communication.?

Certain knowledge that a communication is open to others to read may ipso facto prevent the attachment of privilege.
